The Dip ‘Em Dude Contest (the “Contest”) begins at 12:00:01pm PST October 17, 2012 and ends at 11:59:59am PST on November 18, 2012 (the “Contest Period”).
To enter the Contest, you must do the following during the Contest Period: (1) describe in five hundred characters or less your favorite dude food rule (“Entry”), and (2) Provide your assent to comply with these Rules by clicking the submit button.
To upload your entry, follow the instructions at www.break.com/kfcdippingrules. Submit your Entry directly to the Contest upload page. Proof that you submitted an entry does not constitute proof or evidence that all or any portion of your entry was actually received by Sponsor within the Contest Period. Entries become the property of TMFT Enterprises, LLC (“Break Media”), the Sponsor of the Contest, and will not be acknowledged or returned. Personal information collected from entrants will be used in compliance with Break Media’s Privacy Policy, located at http://www.breakmedia.com/privacy-policy.
Entrants must comply with registration instructions when submitting their Entries.
Any Entry or portion thereof that is, in Break Media’s sole discretion, obscene, profane, lewd, defamatory, contains any third-party materials, or otherwise violates any law or infringes (or may infringe) any copyright, trademark, or other proprietary right of any person, or is otherwise objectionable, will not be considered. Break Media shall have the sole discretion to determine whether a submission qualifies as an Entry. Each Entry must be the original work of the entrant. The term “original” means that the Entry was newly created by you and is not obtained or copied from anyone or anywhere else. “Original” also means that you, and no one else, have complete and unrestricted right, title and interest in and to your Entry, and that you have the right to give to Break Media all of the rights in and to your Entry. You should be sure that you have the right to use the name and any other information of any other person or entity contained in your Entry. Automated, script, macro or robotic Entries submitted by individuals or organizations will be disqualified. Entries that are determined by Break Media to violate these Rules will not be posted online and will be disqualified from the Contest.
At the end of the Contest Period, a panel of moderators chosen by Break Media in its sole discretion will select the winners. All eligible Entries will be judged on the following criteria, in equal parts originality, humor, creativity.
The decisions of Break Media shall be final and binding in all respects.
Grand Prize: One (1) Grand Prize will be awarded in the Contest consisting of a trip to Las Vegas, NV for four (4) people on or about February, 2012, including travel and lodging (four (4) roundtrip economy plane tickets from any major airport in the Continental U.S., and two (2) nights (two (2) rooms) at a Las Vegas hotel selected by Break Media). The trip is subject to airline and hotel availability and blackout dates. Ground transportation (other than to/from the airport/hotel) and food are excluded. Winner’s travel companions must be eighteen (18) years of age or older. The approximate retail value ("ARV") of the GrandPrize is $2,500.
Second Prize: One (1) Second Prize will be awarded in the Contest consisting of: one (1) Xbox 360 (ARV $299.99); one (1) NHL 2013 videogame by Electronic Arts (ARV $59.99); one(1) Madden NFL 2013 videogame by Electronic Arts (ARV $59.99); one (1) Sports FIFA 2013 videogame by Electronic Arts (ARV $59.99); one (1) NBA Jam videogame by Electronic Arts (ARV $19.99); and one (1) 2K Sports MLB 2K12 video game by Electronic Arts (ARV $40.00). The “Electronic Arts” trademark is a registered trademark of Electronic Arts, Inc., which is not a sponsor of this Contest.
Third Prize: Four (4) Third Prizes will be awarded in the Contest consisting of one (1) KFC Chicken Checks” gift check in the amount of $50.00 (ARV $50.00). KFC “Chicken Checks” are issued by the KFC National Council and Advertising Cooperative, Inc. (“NCAC”), are good for food purchases at participating KFC® restaurants in the United States, and are subject to the terms and conditions listed thereon. The “KFC” trademark is a registered trademark of KFC Corporation (“KFCC”), which is not a sponsor of this Contest.
In the event the Grand Prize winner’s residence is less than two hundred miles from Las Vegas, Nevada such that air transportation is deemed by Break Media in its sole discretion to be unnecessary, the Grand Prize will not include air transportation from such winner’s residence and no other substitution or compensation will be provided in lieu thereof. The Grand Prize winner and his or her travel companions must travel together on the same itinerary and must possess all required travel documents, including visas and valid passports, if and as applicable, and comply with any applicable hotel check-in requirements, such as presentation of a major credit card. All aspects of the travel portions of the Grand Prize must be conducted on such dates as determined by Break Media in its sole discretion. The dates of departure and return are subject to change at Break Media’s sole discretion. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. Other travel restrictions and blackout dates may apply. All airline tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes. The ARV for travel prizes may vary depending upon points of departure and destination and fare fluctuations. Break Media reserves the right to structure travel routes and select hotels in its sole discretion. The ARV for travel prizes is an estimate made before the Contest begins. The Grand Prize winner will not receive cash or any other form of compensation if actual travel costs are less than the estimate made in these Official Rules. The round trip air transportation element for any travel prize begins and ends at the point of departure. A deposit or presentation of a credit card by the Grand Prize winner may be required at the time of check-in at the hotel. Any hotel cancellations or changes to hotel reservations after confirmation must be made with the hotel directly, and the Grand Prize winner is solely responsible for any charges and/or fees arising from changes made directly with the hotel. In the event the Grand Prize winner and/or his or her travel companions engage in behavior that, as determined by Break Media in its sole discretion, is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Break Media reserves the right to terminate the trip early, in whole or in part, and send the Grand Prize winner and/or his or her travel companions home with no further compensation.
Prizes are not transferable and no substitutions or cash equivalents are permitted. Break Media reserves the right to substitute a prize with one of comparable or greater value, at its sole discretion. If a Prize is not claimed within the specified time limit the prize may, in Break Media’s sole discretion, be forfeited, and an alternate winner selected using the judging and other criteria described herein. Federal taxes, local state taxes, taxes, V.A.T. taxes, and any other fees or costs connected with prize acceptance and/or use not specified herein as being provided will be the sole responsibility of the winners. Such costs may include, without limitation: federal, state, provincial or local taxes or government surcharges or fees; and expenses not specified herein. Any difference between actual value and stated ARV will not be awarded.
NOTIFICATION: On or about December 1, 2012, Break Media will notify the winners by email and/or telephone. The winners (or a winner's parent/legal guardian if winner is deemed a minor in his/her state of residence) will be required to sign and properly execute, a liability waiver, and to the extent legal, publicity release form(s) (collectively called “Release Forms”) and return them within three (3) days of receipt. If such forms are not properly returned on a timely basis or a prize notification is returned as undeliverable, or if the potential winner is found to be ineligible or not in compliance with these Rules, the applicable Prize will be forfeited.
ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY BREAK MEDIA, WHOSE DECISIONS ARE FINAL AND BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE PROMOTION SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND THE ELIGIBILITY OF THE ENTRY HAVE BEEN VERIFIED, ALL REQUISITE DOCUMENTATION HAS BEEN COMPLETED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
No substitution, barter, transfer, or assignment of prize permitted, except that Break Media, in its sole discretion, may choose to substitute a prize of equal or greater value.
Except to the extent prohibited by applicable law, by entering the Contest, entrants and any other individuals appearing in an Entry agree that Break Media, KFC, and each of their related and affiliated companies may use the name, address (city, state), photograph, videotape, voice, likeness and/or prize information of any entrant or individual included in the Entry for advertising, publicity and promotional purposes in any media, throughout the world, without further notice and/or compensation. Entrant represents and warrants that he/she has the right and power to provide such authorization on behalf of any individual featured in the Entry.
This Contest is open only to legal residents of the 50 United States and District of Columbia, 18 years of age or older at the time of entry. Employees of Break Media, KFC, NCAC, and their respective affiliates, subsidiaries, franchisees and licensees, members, advertising and promotion agencies, and their immediate families (spouse, parents, children, siblings and their respective spouses) and individuals living in the same household as such employees are ineligible to enter or win the Contest.
BY PARTICIPATING IN THE PROMOTION, ENTRANTS AGREE TO ABIDE BY THE TERMS OF THESE RULES AND THE DECISIONS OF BREAK MEDIA, WAIVE ANY RIGHT TO CLAIM AMBIGUITY IN THE RULES, AND RELEASE, INDEMNIFY AND HOLD HARMLESS BREAK MEDIA, KFC, NCAC AND EACH OF THEIR RESPECTIVE AFFILIATES, SUBSIDIARIES, FRANCHISEES AND LICENSEES, MEMBERS, ADVERTISING AND PROMOTION AGENCIES AND THEIR RESPECTIVE AGENTS, REPRESENTATIVES, OFFICERS, DIRECTORS, SHAREHOLDERS AND EMPLOYEES, (COLLECTIVELY, “RELEASEES”) FROM AND AGAINST ANY INJURIES, LOSSES, DAMAGES, CLAIMS, ACTIONS ANY LIABILITY OF ANY KIND RESULTING FROM OR ARISING FROM PARTICIPATION IN THE PROMOTION, OR ACCEPTANCE OR USE OF ANY PRIZE. EXCEPT AS OTHERWISE SET FORTH BELOW, ENTRANTS AGREE THAT VENUE AND JURISDICTION SHALL BE EXCLUSIVELY IN THE FEDERAL AND STATE COURTS LOCATED IN THE STATE OF CALIFORNIA AND ANY AND ALL DISPUTES SHALL BE GOVERNED BY THE SUBSTANTIVE LAWS OF THE STATE OF CALIFORNIA WITHOUT REGARD TO THE CONFLICTS OF LAWS PRINCIPLES TEREOF.
If an entrant changes his/her telephone number, email address and/or street address after he/she enters the Contest, it is his/her sole responsibility to notify Break Media by (postal) mailing notice to Break Media’s address (listed below) to be received by the end of the Contest Period. Releasees are not responsible for printing or typographical errors in any Contest related materials; or for transactions (including Entry submissions) that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any web site associated with this Contest, or process any transaction thereon.
If for any reason the Contest cannot be executed as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Break Media that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Contest, or if this Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, Break Media reserves the right to terminate, modify or suspend the Contest or any portion thereof, including these Official Rules. If the Contest is terminated before the original end date, Break Media may, but is not obligated to, select the potential winner from among all eligible, non-suspect Entries received as of the termination time/date.
Break Media reserves the right to modify or terminate the Contest in its entirety at any time and at its sole discretion, without liability. The Contest may be terminated or modified prior to the stated expiration date. If so, a notice will be posted on break.com. Any attempt by an entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Break Media reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Any attempts by an individual to access any website associated with this Contest via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible. Use of automated entry devices, or Contest entry services or programs are prohibited.
All Entries (both winning and non-winning) become the property of Break Media and will not be returned. All elements of all Entries, including all United States and international copyrights and all other intellectual property rights in the entries, shall be owned exclusively by Break Media. Submission of an Entry constitutes your assignment and transfer to the Break Media of any and all rights, title and interest in your Entry, without limitation, including all copyrights and trademark rights, and your waiver of all moral rights. By entering the Contest, you hereby warrant and represent that your Entry is original and does not infringe the rights of any third party and hereby agree not to instigate, support, maintain or authorize any action, claim or lawsuit against Break Media or its affiliates, or any other person, on the grounds that any use of your Entry, or any derivative works thereof infringe any of your rights as creator of the Entry, including, without limitation, trademark rights, copyrights and moral rights or “droit moral.” Nothing herein shall constitute an employment, joint venture, or partnership relationship between you and Break Media. In no way are you to be construed as the agent or to be acting as the agent of Break Media in any respect. By submitting your Entry and agreeing to these Rules, you agree to execute any and all additional documents proposed by Break Media to effectuate and confirm its sole and exclusive ownership of all copyrights in and to your Entry, and hereby irrevocably appoint Break Media as attorney-in-fact to execute any and all such documents if you fail to return the same to Break Media, duly executed, within three (3) days following submission of the particular document by Break Media to you. Without limiting the generality of the foregoing assignment, Break Media or its designees, including, without limitation, KFC, shall have the right to edit, adapt, modify, reproduce, promote, display, distribute, perform, assign and otherwise use Entries, any portion thereof and any component thereof (including, without limitation, name, likeness, voice, performance and photograph of any individuals featured therein) in any way it sees fit, in any medium now known or hereafter devised, including, without limitation, television commercials and for any advertising and promotional purposes, without additional compensation, except to the extent prohibited by applicable law. Entrant represents and warrants that he/she has the right and power to grant such rights on behalf of any individual featured in the Entry.

All federal, state and local laws apply and this Contest is void where prohibited or restricted by such laws, including but not limited to jurisdictions with laws that would require registration, disclosure, filing, trust account, or posting of a bond, or any other requirements, that are not satisfied by these terms and conditions. If any provision of these rules is held to be illegal or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these rules shall otherwise remain in full force and effect and enforceable to the fullest extent permitted by applicable law.
