Some dumb Indiana Sheriff sits back and does absolutely nothing while an even dumber health inspector trespasses on private property without a warrant. I hope both these people got fired because this guy couldnt be more correct about his constitutional rights to privacy. Smart of him to get it all on film.

    sorry peoples, did some research. this guy had his case dismissed. Indiana Code 16-20-1-23 allows a health inspector to enter a property if they believe there is a source or cause of disease. However they're supposed to have given prior notice that they'll be showing up, and seems to me it's a little conflicted with federal law? Either way, he got dismissed.

    A: They have probable cause. "Moving Dirt" would be just that. If you start digging a giant hole, you are going to hit something. If you hit something bad, well thats a health violation.... B: If an officer asks you your name, you are required by law(in most states) to give them your name. Since he never gave up his identity, there was no way to verify he was the owner of the property denying them access.

      @sLaPiTA: Possibility of hitting any lines or anything is a Building inspector issue, not health. B: Yes you are required to reveal your identity to officers but the officer is also required to provide an explanation of why she is there, and why he is asking for identification.
