There's plenty of overhead clearance to use the machine. That blue thing is in the foreground, not over the top of the boom. Maybe there is something critical buried there. Maybe they're just dumb. Who knows.

That's fill dirt, not top soil. It was probably put down to protect some utility lines below. There are lots of good reasons to move dirt by hand in tight quarters.

Okay, in truth we do this sometimes. When your backfilling over top of plumbing, and conduit you cant have rocks, so you hand shovel a bucket and spread it with the excavator. It's less work than trying to throw the dirt 20'.
