Bikes only have the right of way in a bike lane. Otherwise they are an UNMOTORIZED VEHICLE that needs to stop at lights and give right of way like any other vehicle on the road. However, many cities have adopted specific laws for bicycles so of course those might be exceptions......

  @ronintetsuroYou must be american if your immediately looking to blame someone( for the lawsuit) before even inquiring about the condition of: Being on a bike does not equal instant right of way. Mentality like that is often argued by the family of the biker because the bikers stunt got him killed and couldn't make it to court.

  @ronintetsurothe biker is at fault because: he did not signal before switching lanes AND he pulled out in front of that car in the first place. That is why he went into the far lane.

Yeah: cyclist would be mainly at fault, with an unsafe lane-change (no signal) but the car driver would get it too for failing to remain in control. If I saw a bike anywhere in front of me, I'd be watching like a hawk, expecting him to do shit like that.
